1) Effective Date
This Agreement shall be effective commencing as of the day payment is received for the setup and shall continue until terminated at the written request of either party.

2) Accountability
Agency shall not be responsible or liable for any damages to the Company by reason or failure to publish any advertisement provided for herein because of any labor dispute, strike, war, riot, insurrection, civil commotion, fire, flood, accident, natural disaster, or cause beyond the control of the Agency. Company assumes full and complete responsibility and liability for the content of all advertising copy submitted and published pursuant to this Agreement and shall indemnify and hold the Agency harmless against any demands, claims, or liability arising there from.

3) Entire Agreement
This writing contains the entire agreement of the parties. No representations other than those expressly set forth in this Agreement were made or relied upon by either party. No agent, employee or other representative of either party is empowered to alter any of the terms of the Agreement, unless done in writing and signed by a representative of the Agency and Company.

4) Refund Policy
The maximum refund amount for any and all services is 50% and must be requested within the first half of the billing cycle.

Monthly Services - refunds must be requested by the 15th of the month. Cancellations within 3 days of the next billing cycle.

Fixed Term Projects - Clients may cancel at any time up to 3 days before the next milestone or phase payment. Payments made at the beginning of each phase/milestone are non refundable.

5) Cancellation Policy
This agreement may be terminated by either party at any time, with written consent within 3 days of next billing current. If terminated, agreement will cease at the end of current billing cycle. All ads will be turned off and any assets that ACT Marketing holds will be handed over to the client at the end of billing cycle.

6) No Guarantee
Client understands that there are no guarantees of performance or results. Agency will act in it’s full capacity to deliver positive and profitable results but can not guarantee followers, likes, prospects, email signups, subscribers, customers, clients or income.

7) Entire Agreement
This writing contains the entire agreement of the parties. No representations other than those expressly set forth in this Agreement were made or relied upon by either party. No agent, employee or other representative of either party is empowered to alter any of the terms of the Agreement, unless done in writing and signed by a representative of the Agency and Company.

How Do I Cancel or Get A Refund?
Our engagement is month to month. If you ever feel as though you are not receiving value; you can cancel at any time and you will not be billed again.

Given the massive time investment I’m taking for each client, there are no free trials or refunds.
How Long Does Coaching Last?
You're in the driver's seat here. The program is flexible to you with no long-term contracts. So we will work together until you achieve your goals or decide you're ready to go it alone.
How Does Scheduling Work?
You’ll receive access to a private client only booking page. You’ll be able to book your calls at a time that works best for you.

As an avid traveler, time zones are no issue and whatever your schedule we will find a time to meet. If you decide to skip a session they do not carry over to the next month.
Will I Have Access To Ask Questions Outside Our Scheduled Sessions?
YES! You’ll receive access to a private project on a software called Basecamp. You’ll be able to log-in to ask questions, share files, and more. If you prefer email, you’ll be able to do that too.
What If I’m Not Satisfied With The Coaching?
You can cancel at any time if you don’t find value in working together. You get to keep any session recordings, files, and tools we’ve worked on together.
What if I Don’t Have The Time To Commit To Coaching Sessions?
If you really can’t commit to 2 sessions per month then the email only plan may work better. In fact some clients skip the calls and ask me to use their session copywriting or researching b/c they are so busy....
